Terms and Conditions

6. Delivery

Christmas & New Year Orders: Orders placed over the Christmas period will be processed when we return on 6th January 2025. Production will then begin, and orders will be dispatched from mid-January 2025 onwards.

In the United Kingdom

  • Standard Shipping: £3.95

 

  • Dispatch Times: Each of our items is bespoke and individually made. For this reason, we aim to dispatch orders within 10 to 14 days from the date of purchase, unless otherwise specified (e.g., during the Christmas period as noted above).

  • Shipping Services: We use trusted shipping services, including Royal Mail, DPD, and DHL. Once dispatched, delivery typically takes 3-5 working days, but this may vary depending on the courier and your location. Please note that this timeframe is for shipping only and does not include the production time of 10 to 14 days.

International Shipping

  • Custom Shipping Costs: Special rates apply for overseas shipping. Please contact us for a personalised quote and confirmation of the shipping method and delivery times.

 

Delivery Time

Once production is complete and your order has been dispatched, you should allow 3-5 working days for UK delivery. This timeframe is post-production and after dispatch, not from the date of purchase.

We will notify you as soon as your order has been shipped. If there are delays or issues with stock, we will inform you promptly.

Packaging

We take great care to package orders securely to prevent damage during transit. If your order arrives damaged, please contact us immediately through our contact page, providing details and photos of the damage so we can resolve the issue as quickly as possible.

7. Returns and Refunds

  • Non-Returnable Nature of Goods: Due to the personalised nature of our Goods, returns and cancellations are not accepted once an order is confirmed. This is in accordance with the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, which exempts bespoke and personalised items from standard cancellation rights.  

  • What are Defective Goods? We take great care in creating your personalised ornaments. However, if an item arrives damaged, broken, or significantly differs from the approved artwork preview due to an error on our part, it may be considered defective. Please note that minor variations in colour, necessary trimming of artwork near the edges, and the placement of the ribbon hole, as described in Section 4, are part of the normal production process and are not considered defects.

  • Refunds or Replacements: Refunds or replacements are issued only for defective Goods or errors caused by us.

  • Claims Process: Claims for defects must be made within 14 days of delivery to the school, nursery, or club, with photographic evidence sent to post@pot-inc.co.uk. After reviewing the photographs provided, we will assess the claim and determine whether a refund or replacement is appropriate. In some cases, we may request that the defective product be returned to us for further inspection before a refund or replacement is issued.

  • Refunds: Refunds will be processed within 14 days of either:

    • Our review and acceptance of the photographic evidence provided in the claim, or

    • Our receipt and inspection of the returned defective goods, if a return is requested.

We will notify you of our decision after completing the review or inspection.

  • Exclusions: Refunds or replacements will not be issued for:

    • Incorrectly approved artwork.

    • Damage caused by the customer or during transit after delivery to the school, nursery, or club.

    • Minor variations in colour or finish that fall within the acceptable range, as described in Section 4.

    • Products matching the approved artwork preview but showing slight colour or trimming variations (as described in Section 4).

  • Delivery delays: Delivery delays caused by unforeseen circumstances, including but not limited to postal disruptions or school closures, do not qualify as grounds for a refund or cancellation unless agreed upon with us in writing.

8. Liability

  • Our liability is limited to the cost of the Goods purchased.

  • We are not responsible for:

    • Errors in the final product approved by you during the ordering process.

    • Damage caused during shipping unless due to our negligence.

    • Delays caused by external factors (e.g., shipping delays).

    • Losses resulting from your failure to comply with these Terms.

  • We are not liable for delays in delivery caused by external factors, including but not limited to postal disruptions, adverse weather, or school closures. Orders delayed beyond the intended delivery date of 18th December 2024 will be fulfilled as soon as possible and do not constitute grounds for refunds or cancellations.​

9. Intellectual Property

  • All designs and products created by us are our intellectual property. They may not be reproduced or resold without our permission.

  • Our trademarks, logos, and branding may not be used without our prior written consent.

10. Disclaimers

  • Product Condition: We take great care in creating your personalised ornaments. However, we want to be upfront that we cannot guarantee that every ornament will be absolutely perfect. Minor variations in colour, texture, or finish are normal and are not considered defects.

  • Suitable Use: Our ornaments are designed to be decorative items. Please handle them with care, as we are not responsible for any damage caused by misuse or accidents.

11. Force Majeure

We are not liable for delays or failures caused by events outside our control, including natural disasters, strikes, and supply chain disruptions.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Agreement to Terms

By placing an order with Cwmni Pot-inc, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

1. Introduction

Welcome to Cwmni Pot-inc.

These Terms and Conditions govern your use of our website and the purchase of any goods from us. By placing an order, you agree to be bound by these terms, so please read them carefully.

Cwmni Pot-inc is a trading name of Hedyn Cyf, a private limited company registered in Cardiff (Company Number: 07006950). Our registered office is located at 24 College Road, Bangor, Gwynedd, LL57 2AN.

2. Definitions

  • "Conditions": These terms and conditions.

  • "We", "Us", "Our": Cwmni Pot-inc, part of Hedyn Cyf.

  • "Goods": Products we provide, including bespoke ceramic ornaments featuring children's artwork.

  • "You", "Your": The person or entity purchasing from us.

  • "Website": www.pot-inc.co.uk

  • "Order": Your request to purchase Goods from us.

Ordering and Approval

  • Personalised and Non-Returnable: All products are custom-made to order based on a child's artwork provided by their school, nursery, or club, along with the personalisation text and design choices you make during the ordering process. Due to their personalised nature, orders cannot be cancelled, amended, or returned once submitted.

  • Confirming Your Child's Artwork: You are responsible for ensuring the artwork displayed in the preview is the correct artwork for your child.

  • Reviewing the Artwork Preview: Carefully review the artwork preview before placing your order.

    • Artwork Placement: Pay close attention to how the artwork is positioned within the template, as elements near the edges of the circle are likely to be trimmed during production. Please see Section 4 for details.

    • Ribbon Hole: Please note that a hole will be located in the ornament for the ribbon, which may remove or obscure elements of your child's artwork.

Personalisation Text:

  • Accuracy: The text you enter for personalisation is case-sensitive and will appear exactly as entered, including all capitalisation, punctuation, and spacing. Please double-check the text carefully before submitting your order.

  • Confirmation: During the ordering process, you must tick a checkbox to confirm that you have reviewed and approved the spelling and accuracy of the personalised text. By ticking this box, you accept full responsibility for the accuracy of the text provided.

  • Character Limit: Personalisation text is limited to 20 characters, including spaces. Text exceeding this limit will not be accepted.

  • Design: Personalised text will appear exactly where indicated in the design images, replacing the placeholder text "(Your Text Here)" or "(Eich Testun Yma)". Other design elements, including the date, are fixed and cannot be customised or removed. While the text is designed to fit as shown, minor adjustments to its size may be made to ensure the best visual fit.

  • Contact Us: If you have any questions or concerns about the artwork or the ordering process, please contact us immediately at post@pot-inc.co.uk or 01248 305071 before placing your order.

  • Non-Returnable Nature of Goods: By submitting your order, you agree to the non-returnable nature of these personalised goods, as described in Section 7.

4. Artwork and Production

We provided detailed guidance to all project hosts (e.g., schools, nurseries, or clubs) to ensure artwork submissions meet production requirements. These guidelines were also included on the back of the artwork template, and participants were advised:

  • To keep important elements of the artwork away from the edges of the template to avoid trimming during production.

  • About the location of the ribbon hole and how it might obscure or affect some parts of the artwork.

  • On suitable materials and methods to create artwork for the best reproduction results.

Every effort has been made to provide clear and detailed instructions, ensuring participants have the guidance needed to create artwork that preserves important details and minimises the risk of being lost or affected during the production process. Cwmni Pot-inc cannot be held responsible for issues arising from failure to follow these guidelines.

  • Image Clarity: Please be aware that the process of transferring a child’s artwork to ceramic involves a change in medium. While we strive for the best possible reproduction, some slight loss of detail or clarity in the final image may occur due to the nature of the transfer process. This is considered normal and is not a defect.

  • Colour Variations: Minor variations in colour may occur between the original artwork, the scanned image, the online preview, and the final printed product. These differences are due to screen displays, scanning, and the printing process itself. Such variations are normal and are not considered defects.

  • Artwork Placement and Trimming: Artwork elements near or along the inside edge of the template may be trimmed during production.

  • Ribbon Hole: Any artwork affected by the location of the ribbon hole is necessary to produce the ornament.

  • Production Time: Please allow approximately 14 days to produce your personalised ornament.

By placing an order, you confirm that you understand and accept these production guidelines.

5. Price and Payment

  • All prices are in Pound Sterling and include VAT unless otherwise noted.

  • The final price, including delivery charges, will be confirmed at checkout.

  • We reserve the right to change prices without notice. Changes will not affect orders already placed and confirmed.

  • Payment must be made in full before production begins. We accept Visa, Mastercard, Apple Pay, and Google Wallet.
